Artwork, Design and Intellectual Property Policy

Sunrose Branding, LLC (”Sunrose Branding,” “we,” “our,” or “us”) respects the intellectual property rights of our clients, creative professionals, suppliers, and other rights holders. This Artwork, Design and Intellectual Property Policy explains ownership, responsibilities, approvals, licensing, and the use of creative materials provided to or created by Sunrose Branding in connection with our Products and Services. This policy should be read together with our Terms and Conditions of Sale, Privacy Policy, and other applicable agreements.
Client-Owned Materials
Clients retain ownership of intellectual property they provide to Sunrose Branding, including, where applicable:
- Logos
- Trademarks
- Service marks
- Copyrighted works
- Brand guidelines
- Artwork
- Photography
- Videos
- Marketing materials
- Documents
- Product designs
- Other creative assets
By providing these materials, the client represents that they own or have obtained all necessary rights, licenses, and permissions required for Sunrose Branding to use them in connection with the requested Products or Services. Clients remain solely responsible for the legality and authorized use of all submitted materials.
License to Use Client Materials
By submitting artwork or other creative materials, the client grants Sunrose Branding a limited, non-exclusive, non-transferable license to:
- Store submitted materials.
- Review submitted materials.
- Modify files as reasonably necessary for production.
- Reproduce materials in connection with approved projects.
- Share materials with authorized production partners, manufacturers, suppliers, and subcontractors solely to complete the requested Products or Services.
This license ends upon completion of the project except to the extent retention is reasonably necessary for record-keeping, legal compliance, future reorders authorized by the client, or protection of our legal rights.
Sunrose Branding Creative Work
Unless otherwise provided in a written agreement, Sunrose Branding retains ownership of:
- Preliminary concepts
- Draft designs
- Working files
- Design systems
- Templates
- Creative methodologies
- Internal production files
- Software
- Processes
- Tools
- Documentation
- Proprietary workflows
- Educational materials
- Other pre-existing intellectual property
Clients receive only the rights specifically granted under the applicable agreement.
Custom Design Projects
For custom creative work produced specifically for a client, ownership and licensing will be determined by the applicable proposal, agreement, statement of work, or invoice. Unless otherwise agreed in writing:
- Final approved deliverables intended for the client become licensed to the client for their intended business use upon full payment.
- Working files, editable production files, internal templates, and development assets remain the property of Sunrose Branding unless specifically included within the project scope.
Any transfer of copyright ownership must be expressly stated in a written agreement signed by both parties.
Third-Party Intellectual Property
Certain projects may incorporate:
- Licensed fonts
- Stock photography
- Stock video
- Music
- Software
- Templates
- Illustrations
- Manufacturer artwork
- Other third-party materials
Ownership of third-party intellectual property remains with the applicable rights holder. Client use of such materials remains subject to the applicable license terms. Sunrose Branding cannot transfer rights we do not own.
Artwork Requirements
Clients are responsible for providing production-ready files whenever required. Where artwork requires modification, recreation, vectorization, color correction, formatting, or other preparation, additional design services may apply. Acceptance of artwork does not constitute verification that the client possesses the necessary legal rights to use that artwork.
Proofs & Approvals
Clients are responsible for carefully reviewing all proofs before granting final approval. Final approval confirms acceptance of all visible aspects of the project, including:
- Spelling
- Grammar
- Layout
- Dimensions
- Colors
- Placement
- Quantities
- Product specifications
- Personalization
- Other project details
Production begins only after required approvals have been received. Once production has begun, additional changes may not be possible and may result in additional charges.
Color Matching
Sunrose Branding makes commercially reasonable efforts to reproduce colors accurately. However, colors may vary due to differences in:
- Computer monitors
- Mobile devices
- Printing methods
- Materials
- Fabrics
- Decoration methods
- Manufacturing tolerances
- Lighting conditions
Exact color matching cannot be guaranteed unless specifically agreed in writing.
Portfolio Rights
Unless otherwise agreed in writing or restricted by confidentiality obligations, Sunrose Branding may display completed public-facing work in our:
- Portfolio
- Website
- Marketing materials
- Presentations
- Social media
- Awards submissions
- Educational materials
Confidential, proprietary, or non-public projects will not be displayed without authorization.
Client Warranties
By submitting materials to Sunrose Branding, the client represents and warrants that:
- They own or control the necessary rights.
- Their materials do not infringe upon the rights of others.
- Their materials comply with applicable law.
- They possess authority to authorize production.
Clients agree to indemnify and hold Sunrose Branding harmless from claims arising from unauthorized use of submitted materials.
Intellectual Property Infringement
Sunrose Branding respects intellectual property rights. If you believe material produced or displayed by Sunrose Branding infringes your intellectual property rights, please contact us promptly with sufficient information to investigate the matter. Where appropriate, we will review the claim and take reasonable action consistent with applicable law.

Sunrose Branding does not provide legal opinions regarding copyright, trademark, patent, licensing, or intellectual property ownership. Clients should consult qualified legal counsel regarding intellectual property matters affecting their business.
Changes to This Policy
We may revise this Artwork, Design & Intellectual Property Policy from time to time to reflect changes in our business practices, legal obligations, or operational procedures. Updated versions will be posted on this page with a revised “Last Updated” date.
